Back Molar Decay Decay

In Chile, 18 Mapuche on the dock: a mock trial

D ix-eight men of the Mapuche indigenous community are accused by many of the Terrorism Act offenses, the principal is to have organized an "ambush" and wanted to achieve, pistol shots, a caravan of armored vehicles. The firefights were the three minor injuries alongside police officers.
After two months a semblance of a trial where the prosecution has passed more than 100 witnesses on the stand, most of whom are police officers and witnesses protected "testigos sin rostro " Anonymous, it's the turn of the defense to speak.
The penalties incurred by the Mapuche range from 50 to 103 years in prison. They are accused of being murderers, terrorists, thieves.
But just look a little closer to the situation to wonder who really is the victim
  • the logging company complainant, who owns 700 000 hectares of land?
  • the Chilean State , complaining too, which is responsible for the colonization of the Mapuche territory?
  • or Mapuche , including all land (per 800 000 persons), while in Chile, and for all communities, less than 600 000 hectares?
This "trial" European observers describe as burlesque as it goes against the basic rights the right to defense deserved some attention here in detail.
So we met Michael Barbut, who is closely following this case as an observer for the collective solidarity of the Mapuche people, composed of organizations defending human rights and defense indigenous peoples.
This young French is preparing a doctoral thesis in political science in Paris -I on the process of mobilization and politicization in a Mapuche community in a historical perspective.
After a lengthy interview with Michael, I thought it was better to introduce this topic into two parts, so you better understand the context in which the trial fit. They will talk about the first trial and then the history of the relationship between the state and the Mapuche communities Lieu-Lieu .

The trial

The trial of the nineteen Mapuche began November 8, 2010. Barbut Michael was able to take part in the trial as an observer.
Cristina Man: How were you able to follow this trial?
Barbut Michael: The first day I showed my ID, I was saved, I said I was "observer" because I wished that it be notified.
Can you describe this process?
A large room of 50-60 m2 divided in two by a Plexiglas window. On one side the court, on the other the public. Side court, a platform where three judges are sitting with their assessors, clerks, opposite the Crown represented by three attorneys who carry out interrogations. On their side, a legal representative of the forestry company Mininco (which belongs to the powerful family Matte) that is part of the trial as a plaintiff, and two lawyers representing the state, also complaining.
Facing them, six defense lawyers, including four private and two public defenders provided by the state. Behind these lawyers, twelve Mapuche prisoners on eighteen. The other six are not required to be present, they do not come every day because it's expensive: Cañete, where the court is about an hour of communities, by bus. The trip costs 2,500 pesos (4 euros). It's a lot to Mapuche farmers.
What is the framework of the charge?
Many crimes are more serious at stake is what the prosecution calls the "Fiscal Elgueta attack" in October 2008. Elgueta was to investigate the "Mapuche conflict" in the region.
The theory of the attack or premeditated ambush is denied by the defense, but also by people like Judge Guzman speaking of confrontation and legitimate right to defend itself. The charged wishing to prevent the police (came into force and armored: fifteen vehicles) to carry out a violent raid, a "allanamiento" , as the police regularly Mapuche communities, destroying everything, using and usurping the power of intimidation means that the appearance of 50 or 100 soldiers in helmets and armed in a small tin house, ripping open bags of seeds, destroying crops, agricultural tools, and shoving women and children.
there were deaths? Seriously injured during the shootout?
After an exchange of fire that occurred on the road along the Mapuche territory, there were three minor injuries. The Public Elgueta and two policemen. To do this, and for a series of other minor offenses, some Mapuche defendants may pay between 50 and 103 years in prison ...
What other crimes allegedly committed the Mapuche?
They are accused of setting fire to the forest companies and properties stolen timber. And that's where the rub, because if the land legally belongs to the business, and they have a paper that certifies their property, it is the product of expropriation in the nineteenth century, whose victims were communities Mapuche (see the rest of this article coming soon).
These crimes refer to a political conflict. Therefore, over the trial of the Mapuche, the courts are transformed into a space of political expression.
land expropriation is a relatively new issue here: the Mapuche territories were annexed there are only a hundred years by the Chilean government has begun to divide the land and encourage the installation of settlers from Europe to the detriment of the Mapuche. The laws of the time clearly show
The Mapuche did they create an association?
You can not really speak of an association, it is a political organization that was founded in 1997, the Coordinadora Arauco Malleco (CAM). It is then composed of young Mapuche who are not satisfied with the new relationship between the Mapuche and the Chilean State, when the democratic transition. This organization intends to reconstruct the ancestral Mapuche territory and claims control of Mapuche territory. It thus echoes the ILO Convention 169 which provides for indigenous peoples the right to exercise sovereignty on their ancestral land. The Convention was ratified by the Chilean State.
What strikes you when you look at the accused?
youth from their faces. And their laughter, smiles and tenderness of their faces in the dining room to run if the public their family. All this contrasts with the charge of terrorism and the demonization made by certain media. Sometimes they sleep too: one of them told me it was due to voltage drops, the legacy of the long hunger strike they have all followed between July and October 2010.

Chile opened its first investigation into the death of President Allende

"I the will see if there was suicide or not and under what circumstances "Said a judicial source, who requested anonymity.
Salvador Allende, elected president of Chile in 1970 to lead a leftist coalition, died by gunshot in the presidential palace, bombed by the 'Air Force during the coup led by General Pinochet. He was 65.
An autopsy concluded that Allende had committed suicide, but the results are disputed by some political sectors and organizations defense of human rights.
" Justice will investigate what has not been investigated ", simply said the prosecutor of the Court of Appeal, Beatriz Pedrals.
It was she who on Wednesday opened proceedings in this case and in 725 other cases of violations of human rights during the dictatorship (1973-1990), never previously treated for lack of complaints.
" Last year, the lists of victims of the Rettig Report (National Commission for Truth and Reconciliation) have been reviewed and this information was intersected with the complaints so far. We then saw that many cases had not been procedures, "said the judiciary.
The judge assigned to coordinate these issues has asked the Attorney Pedrals to complain instead of victims of dictatorship, which ended in 3150 killed or missing and 28,000 cases of torture.
Currently, 560 former military personnel are prosecuted for crimes committed under military rule.
files opened Wednesday correspond to cases of missing and dead prisoners " whatever reason ," said the judge. It may for example include people killed by a bullet " lost" during a protest.
" We must investigate all crimes. We speak more than 700 cases that have never been investigated, including that of Allende, which gives more weight "to the proceedings, responded Lorena Pizarro, president of the Association of Relatives of Disappeared Detainees.
The arrival in power of Allende had worried the conservative sectors of Chile and the United States, who feared that his " Chilean road to socialism " do not rock the country South America into the communist camp.
Washington had decided to act secretly with the CIA, sponsoring and supporting the coup cons Allende, who had nationalized the major mining resources of the country, such as copper, at the time controlled by U.S. multinationals.
The United States has long supported the then military regime and its economic policy, modeled on the precepts and ultra-liberal monetarists of the Chicago School.
Pinochet died in 2006, 16 years after he left office without having been tried.
Allende's widow, Hortensia Bussi, had fled to Mexico after the coup but had continued to fight dictatorship. She herself died in 2009 at the age of 94 years.
The couple had three daughters, Carmen Paz, Beatriz, who died, and Isabel, Socialist MEP.

Eduardo "Guayo" Labarca, went pee on the grave of Borges

book cover El enigma de los Módulos (The Enigma of Modul
C is well Eduardo Labarca, Chilean writer went to urinate on the grave of Jorge Luis Borges, perhaps the greatest Argentine writer of the twentieth century. All ... tribute to him. Singular, one suspects. Especially that Eduardo is not a young dog crazy. This 72 year old novelist is best known in the country.
Borges soggy
And it was not enough, his act considered sacrilege by the Minister of Culture of Argentina, Jorge Coscia, it will provide small fame. " It is tasteless and offensive. You will not win urinating on a grave , "growls the Minister.
Making the cover of his latest book, prick in hand and spray urine turned toward the grave, the writer says that we better understand his gesture by reading his book. " Pee on this tomb was a legitimate artistic act. The cover of the book is consistent with the content, and can be better understood so , "says he to Guardian.
Hateful citizen
journalist, translator and writer, Eduardo worked for the United Nations and sharing his time between Chile and Vienna. " I'm not just someone who goes around to piss on graves, but a writer with an important work ," he adds.
According to him, to understand his action, we must focus not on the work of Borges, but on the man. " Everyone is offended, since it sees no further than the tip of his nose. Borges was, as a writer, a giant, but I feel utter contempt for him as a citizen. While he was old, almost blind, he came to meet the dictator Pinochet when he was particularly engaged in murder. "Following this meeting, Borges had lavished praise on Pinochet ...
Blame Jean-Sol Pattra
However, Eduardo is not an exhibitionist. He admits he was holding a plastic bottle in hand, and pretended to urinate. And most importantly, it was Jean-Paul Sartre that inspired the act. "Every writer should have originality and breaking with the great artists who preceded him. "
And to ensure he had pissed himself on the grave Chateaubriand. "My act has two meanings: a tribute to the master and the repudiation of citizen," says Eduardo. (See Perfil.com )
